What I really think would be the best possible outcome IMHO in a CoH death senario would be that once NCSoft closes the doors on CoH and Paragon for good (and if they don't release the code or IP), the entirety, or at least majority, of the employees of Paragon Studios form together as their own new small buisness company, and get back to work! Go under a new name (i.e. "Rogue Island Studios"... see what I did there?), and start the creation of a new, oddly similar (but just before Copyright Infringement), Super Hero game called something like "Galactic Heroes", and start taking my money again without the likes of NCSoft, seems like people like the idea of going through Valve. Apparently many people would be willing to contribute to a kickstarter, or w/e, for the creation of your new, yet similar, company. Then, we make you the Super Hero version of Blizzard or Bungie, and you go on to make even more awesome games. I had always heard that the reason a lot of requested things could never happen is because the engine the game was originally built for was too limited, and the only way to fix it would be to build a new game... Now is your chance. I love this game just as much as anyone, and more than most, and this is exceptionally devastating to me for a grab bag of reasons. Life will be forever significantly different, and not necessarily in a good way. But, if it has to end, let's make some BOMB *** lemonade out of these god-aweful, rotten, natsy, bitter lemons. In order to rebuild the game, we must rebuild Paragon Studios. Let's make City of Heroes all of what it was, but also everything it could never have been, but could have been great. Let's make the infamous City of Heroes 2!

Sorry. At some point in there I was overcome and started talking directly to the staff over at Paragon Studios somehow. But I think the point gets across. I want more than just to keep CoH, I want to keep the wonderfully geniused people that make and maintain what it is to this day. If any other group takes CoH over, it will no longer be CoH.
Whatever happens, I am interest and down to help. Already hit up the petition.

As long as I am alive (30yrs down, ? to go) Paragon City will exist, within me. The sun will shine in Atlas Park, the waves will crash on the shores of Mercy, and the buildings of Nova Preatoria will continue to cast their shadows. The rescue effort will continue in Galaxy. And as for me... If you are looking for me, you can find me repeatedly killing 100 infected in the danger zone of Outbreak.

If we're getting serious about just bypassing NCsoft entirely, you've got my suport. I'm an international lawyer, so not much use in IP stuff, but I can call in a favour or two for the scud work of figuring out how to protect the project.
Depending on where you incorporate the entity, you'd be surprised at what you can just do and get away with. There are some countries out there that we'd be able to get away with literally hijacking the game code and reconstructing it word-for-word.
I'd prefer a less-extreme option, of course. Reverse-engineering a similar game is much more defensible, and won't require funding an office in Kazakhstan. Almaty has low start-up costs, strong internet support in the major business district, and the traditional -stan country's 'go to hell' attitude towards legal attacks on its businesses.
The folks over at the Star Wars Galaxies Emulator (SWGEmu) project managed to attain nonprofit organization status, so it isn't unprecedented.

Looks the same issue but slight variation or changes already bypass those rules .
SWG is or anything with STAR WARS has been copywrighted .
If you name it WAR STAR then suddenly it becomes free , all models and names of Star Wars has been copyright , but slight variation and not using the name , releases that again.
So technically they have a to be identical or very similair to the things that are copyrighted protected .
Even then it is a long hard case, what a company does to uphold it .
Like the marvel lawsuit showed , the company are not always responsible for players actions.
Especially in these modern times , if somebody wants to look like spider man online .
Dressed up in spiderman halloween costume , can they sue him ? but call himself man spider (think that one is copyrighted but not sure)
So what part do they uphold , yes if the content creator goes creating everything like a marvel MMO . sure .

You have my support! NCSoft wasn't willing to give anything for Auto Assault or Tabula Rasa, but let's face it the community for City of Heroes is a lot bigger and a lot more family like than either of those mmo's had. God speed, Titan Network!!!

Like a lot of people hearing the news, I am coming out of the woodwork to say something. I will also follow and contribute as this progresses.
We are losing some of the last bastions of golden era MMOs like CoH. Even EQ and DAoC are kind of shaky now, and it just seems inconceivable that any of these would ever disappear. I won't get into my hatred for the modern MMO focus and f2p, just know that I consider it a cancer that absolutely ruins the spirit and intentions of a solid and fair-minded MMO. I know why MMOs might convert and cater to it, often out of need, but that doesn't excuse it.
I have returned to CoH over the years and resubbed because it was always worth it, just to fly again, see the zones and listen to the very evocative music queues. The original login screen theme, Atlas Park, Steel Canyon, etc.
I hope someone is archiving ALL the current zones with fly-throughs and instance runs, to document what is where, mob spawns, music queues and such. Something tells me you are going to need them.
I guess I will never see the changes I wished would eventually be updated into CoH:
- continous zones
- all buildings have interiors you can access
- skyscrapers with huge vertical atriums, working elevator shafts you could hide-and-seek PvP in
- a DAoC-like spin on RvR for superheroes, complete with 100% open-world relics, sanctuaries (keeps) and such - oh, and 3 or 4 sides not just 2 fighting (let's face it, CoH's PvP was *never* even close to the scope and epicness to compliment its awesome PvE universe)
I've been on and off the forums and the game for about 7 years now starting at age fourteen and playing still at age twenty-one. This community has always been nothing but warm and supporting and I'll be damned if this game shuts down without me trying to help anyone who's trying to stop that from happening. Just need to know what to do.
For me the legality of an emulator is no longer morally wrong once NCSoft shuts down CoH. By playing a CoH emulator after that, we're not stealing from NCSoft because we couldn't give them money to play CoH if we wanted to.
If NCSoft won't work with the community and shuts the game down an emulator is the only choice for keeping CoH going in some way.
I know we wouldn't have the wonderful staff and dev team we have now, CoH would I assume exist in a perpetual state of i23, maybe i24 maintenance mode and I'm ok with at least that.
CoH should keep going in some way, shape or form and if that's a stagnant emulator, at least its something.
That said, I'm 100% behind Titan's plan and I hope it pans out, I'll help however I can.
