Shouldn't the Malta Gunslingers use the Dual Pistols set?

They don't want to. Dual Pistols misses occasionally. Malta Gunslingers can hit you reliably through soft-capped defenses with guns held sideways. Even the ones with the eyepatch.

I gave my Dual Pistols guy an eyepatch in the hopes of improving his accuracy. Depth perception is for wimps.

Actually, my theory is that their sunglasses and eye patches are not normal sunglasses or eyepatches at all, but special lenses that let them see the lasers of their laser sights while keeping them invisible to everyone else,(This is a real life trick used by militia that occasionally do use laser sights, although they normally use the lenses in scopes) thus allowing them to keep the scopes on their pistols for long ranged shots.

But otherwise, you have about about why they wouldn't want to use DP.

They already have empty clips, just the MM version.
Also, that's simple, only let bosses have executioner's shot.

no sleep bullets, but it does have three holds and a stun, all the same power actually, just with different ammos.

Syndicate Pistol Initiates use Dual Pistols. But Malta doesn't need to. It's nice to come after them, and go, "How 'bout some REAL dual pistols? BANG BANG!!"

Meh. I made a custom Gunslinger for an AE arc that ended up doing slightly less damage than a Malta Gunslinger. Still gave full XP or near to it with only the Invul passives as a secondary. I can't remember off the top of my head what powers I gave him but I stuck to the less flashy ones, so he probably had both Executioner's Shot and Empty Clips.

Besides, enemy damage can be tweaked to be where the devs want it.

It could be the hats, except we can get those hats too. Unless Malta hand out super extra special hats. It could be all the pouches. They might be full of yellows.

I have to agree with this. In fact, this was something that made me get off my chair and cheer like a little kind in Praetoria:

I'm following an arc about the Syndicate doing majorly bad things, when I'm told their leader is actually a Malta operative from Primal Earth. I figure "Meh, they'll cheat. He'll be just another Syndicate Suit who'll just claim he's from Malta." But then I get to thinking "Well, maybe not. Maybe I'll see the tell-tale hat of a Gunslinger?" That. Was. Aamazing! I mean, he's not just some custom knockoff, the guy WAS a Gunslinger! I'd seen a lot of Dual Blades characters up to that point. Some Resistance bosses are Dual Pistols, BV is Dual Pistols, that idiot Eddie Polstra is Dual Pistols. But this Gunslinger was not like any of them. He wasn't just another Dual Pistols knockoff. He wasn't like those lame replicas you see in the Architect. He WAS a Gunslinger in a suit!

With reference to the replies above, A Titan Called Joe explains why you couldn't pilot a Hercules Titan, let alone a Zeus which is made of two Hercules' joined together.

Well, you couldn't pilot a Hercules without radical surgery, anyway (assuming the toon had a human brain, interfacing a synthetic brain with the Hercules systems would likely be another matter entirely)

Villains don't actually get to find that out though. Unless of course some Vigilante goes running through a Malta mission screaming "They're made out of people!" So maybe the Arbiter is genuinely offering to let you pilot a Zeus and leaving out some of the details just to make you go "yeah, cool! Forget this Rogue thing, gimme the giant robot!"

I'm not sure putting someone's brain in a super powered, army destroying robot is the best way to screw them over...
