Eric, have you not heard of the Marvel lawsuit against this game, where they sued because you could make copyrighted characters from the comics? The settlement in that case pointed out that Cryptic and NCSoft (now just NCSoft) needed to take action against copyrighted characters. If NCSoft doesn't uphold their end of the agreement, we could be going back to court. That would siphon development dollars away to pay for the legal defense, which hurts EVERYONE playing the game.
So, yes, I think that reporting obvious copyright infringement is for the long-term benefit of everyone in the game.
I also love how people calling other people out for doing something wrong is being a 'tattletale.' Seriously, the person was doing something wrong. If they can't face the consequences of that, then they shouldn't have done it in the first place.

I was just thinking the same thing. He appeared in 3 different decades of Avengers titles at least and was the chairman at least for one stint, if I recall.

That is easily the most blatant case of trademark infringement I have seen yet. They did a good job on the costume though.

Name, costume, bio... it doesn't matter to me. If any of those things crosses the line as I define it: petition fired.

I do this too. When it's obvious and smacks you in the face (the character named ***dumpster that was in the virtue d for a while. you bet your booty I petitioned at light speed) I will petition it. Obvious rip-offs get it. "homage" characters I'll think about before deciding whether or not to fire.

I recognised him from that 90's Avengers cartoon, of all things. As well as the giant form of Ant-Man.
That show was pretty cool even if it didn't have Thor or Captain America.
I suspect blissful lack of awareness of the rules (EULA comes up, click OK, play game) is the root issue here. The character is not a clone, hommage, or adaptation, but simply The Vision, created in CoH, right down to the Marvel Universe bio.

The area in the game known as Land of the Lost is so named because it is heavily populated by the Lost, a villain group within the game. It shares no correlation other than name with the TV and movie locale. If it happened to be an alternate dimension populated with dinosaurs, THEN they might have an issue.
A name alone does not make a copyright. You CANNOT copyright commonly used words. This is generally meant as any word that appears in a dictionary.
In the case of the Vision clone seen in the OP's link. The character has the same name, the same appearance, presumably nearly the same powers, and a backstory lifted straight from Marvel's intellectual property. The NAME is not the issue here, it is the fact that it is used in reference to a character that is trademarked.
The word "Vision" cannot be copyrighted, as it is the name of one of your 5 senses, and appears in a dictionary. If I were to name a character "Vision" and state that he is a human gifted with an extraordinary sense of sight, or is clairvoyant, or is a shaman who gets premonitions there is nothing Marvel can do because the word is used in a different context.
On the other hand, if I were to create a character named "Touch" and state that it is an android who happens to be predominantly green and yellow with a red face, with a specific set of abilities, THEN I could be in trouble because I'm infringing on a trademark. The name is different, but it relates to the trademarked name because it is ALSO one of the 5 senses. There is enough similarity to draw a comparison to the trademarked character.
To sum it up: The name has very little to do with trademarking in the case of superhero characters, simply because so many of their names are common words.

I don't even know what it's a violation of. I'm not into the super hero stuff outside of the game. So I have no idea who that even is!
As for people thinking you have to be offline when genericed, think again. My husband saw someone genericed directly in front of him once and the tantrum the ensued was hilarious apparently.

So, would you be upset if Marvel sued NCSoft again and won, getting the entire game shut down....and then you found out that it was because of a character you could have petitioned, but didn't?

I don't feel it's my job to "police" people, and I don't go around petitioning every questionable character I see. And with my comic book knowledge I've seen a LOT of them.
But in the case of the toon linked in the OP? Yeah, I would have petitioned that one in a heartbeat.

I've seen characters' ideas taken from a lot of material(fantasy mostly). The only ones I consider reporting are Super Hero ripoffs (the OP pic is clearly one)
