Interesting strategy. I'm not quite sure what TonyV would declare as a "horrible thing" at this point but it certainly isn't news of the death of City of Heroes as we know it. That's where we differ. But good luck with the declare victory and move forward anyway approach.

So I'm not sure where to reply with this thought, but why don't the folks that are trying to reverse engineer the system and create a new CoH (or CoH like game) start up a KickStarter?

There are a lot of people who buy Paragon points, myself included, that would be willing to save up a bit and chip in to a project like that. KickStarter lets you do a "thank you"/"prize" system for donating. Put a promised pre-order at 100$ and I'm in.

"Reverse engineering" = illegal private server, something I seriously doubt would be allowed on Kickstarter for oh, about a zillion different reasons.

And personally, although I would cheer on any fan-made attempt at a game of some sort, a bunch of "fans" aren't the type of dev team I would pay kickstarter funds to, and I suspect not many other people really would, either. Even many pro teams go bust.

Reverse engineering is not illegal. However, there's still no guarantee that they'll be able to pull it off. If they're sued, will they have the money (and time) to even fight a legal battle?

Maybe they will, I dunno, but while not fundamentally illegal there's sure to be some challenges. I hope they get something nice going but it really is kinda a long shot.

Pretty sure it's against the EULA - while I don't have the CoH EULA handy, it's been a standard feature of every game EULA I've seen.

As I noted, it's against the EULA. Whether it's legally enforceable or not is another matter, but as a matter of integrity, I like to try to abide by my agreements.

People who are loudly proclaiming to be heroes might want to do the same.

NCSoft has engaged in legally dubious activities before. It's likely they don't abide by their own agreements, why should we?

Yeah. The guy's a joke. Y'all can love him to death, but the game has essentially died now. Private servers are a no-go for a billion different reasons, and the dev team is now free to move on without a hint of "what if".

In short, we've lost. That's the reality of the situation. Accept it or not, but that's the fact.

Perhaps so, but that doesn't mean we have to make it easy for them.

Depending on how stubborn they are over the next two months, this could very well end up being a Pyrrhic victory for NCsoft.

Because "we" claim to be better than "them?"

Also, as a result of those activities, NCSoft had to pay $26 million in damages. Are you willing to pay an equivalent amount for using the emulator?

Well meaning but dont think it sanked in with the difference between reality and "ideal" for them yet. I hope they realize before going to on thier way with a good amount of cash and a good idea to being hundreds of thousands if not millions in the hole .If they lucky they get off with a simple cease and desist order.

Actually, I don't think it would go beyond a cease and desist order. It just wouldn't be worth their lawyers' time to go after people who couldn't pay a million dollar judgement anyway.

But then again if they really do have as many celebrity and big time backers, and know people that know people that know people that is an uncle's cousin's baby's momma's hair dresser's dog groomer's friends of a friend' that happen to have connections as they say they do...

Sad part is, if they didnt know that then they really are a little slower than I thought. I hope they didnt think there would be any possible way to kill this game and not lose the players and customers.

On the flip side they may include that loss also as part of the tax write off too.

I was for the effort to save COH , but now we are talking about things that are gray area at best and illegal at worst and that is when I get off the bus.
COH is done. We need to accept it and move on.
