Sounds wonderful but I can see one, very significant, hitch in this plan...
I may have missed this detail in your video but, do you have permission to use the IP? If you do not, and anyone at NC Soft notices, you could be Legalized straight into oblivion.
Other than that, I like the idea and what I've seen so far. I'm not sure it will be a solution that works for me (kind of difficult to Solo a PnP/tabletop game) but please keep working .

There are currently zero plans to monetize the project, and all efforts are going towards releasing this in good faith to the community, possibly backed by a Creative Commons license.
Basically, if ParagonWiki, Mid's, message board roleplay, and other community activities are okay (and I'd be concerned if they somehow weren't), I don't see this effort being an issue. Though, IANAL. I again want to stress that this is by fans, for fans, and we're not looking to profit off of the CoH IP. |

I would definitely be interested in looking into a table top PnP version of City of Heroes. I used to occasionally play Mutants and Masterminds, a superhero PnP roleplaying game that was pretty fun. In fact, it was playing Mutants and Masterminds that inspired one of my gaming buddies to start playing City of Heroes. He then got the rest of the group into CoH. We've recently started playing PnP games again--D&D mostly, but a game based on City of Heroes might suit us well, especially if we can make PnP characters based on our existing MMO characters. (Interestingly enough, some of my first City of Heroes characters were based on my Mutants and Masterminds characters)

One of our main motivations is that even if the lights go out for good on November 30th, we want something out there that can keep heroes patrolling Paragon City to their hearts' content.

Interesting, I bookmarked that link as I like the idea of creating a tabletop rpg.
I've always wanted to get into PnP tabletop games, just got a D&D redbox to start learning how to play, but with a CoH PnP game, that would would absolutely be what i would want to play, I'd love to make my main. *wonder if Vengeance will still be used on me in that version of the game...*
Thanks to everyone that helped make me a welcomed part of the community, and for giving me over 3 years of some of the best gaming I've been able to take part in. May the next game bring many friendships and maybe reconnect to some old CoH friends.

I have about 80 characters in game, just being able to convert a handful of them would be pretty cool. I'll let my group know that this is in the works.

I'm honestly giddy at the chance to write devblogs; when it comes to explaining the nuances of game design I'm an absolute chatterbox. Assuming nothing comes up and I can manage to get off my duff, I'll probably write up one or two within the next few days.

My initial estimate (though vague) may have been farther off than I thought. Basically, IIRC, anything from Issue 0 to Going Rogue, outside of the few still-villain-exclusive sets (Ninjitsu, Pain Dom), is either already largely planned out or has a high chance of being included. Any post-GR sets (Street Justice, Titan Weapons, Water Blast, Nature Affinity) are most likely not going to make the cut for now.

Anything not on that list is still under construction. Some sets, like Dual Blades and Illusion Control, are being set aside, as they're the hardest for us to translate in a way we're happy with. Others, like Energy Aura and Darkness Control, we just haven't worked on yet.
Also, any set that is shared between archetypes, like Willpower or Radiation Emission, will not be the same between archetypes. Willpower on Scrappers, for instance, is getting a stealth power, while on Tankers it's getting a single-target Fear. There will be a video or a blog post on things like that later.

I'm really interested in seeing the changes and additions you made to powersets to better fit the tabletop style. That and how you handle fighting bigger groups of enemies all at once.

Absolute worst case scenario? I do not believe there's anything actionable in a dedicated group of fans using a homebrew game system to play a superhero game and the GM just happening to take inspiration for how the game is run from a certain wiki about a certain superhero MMO.
The only major legal issue I could legitimately see rearing its ugly head is one of trademark, should our game somehow explode in popularity while the CoX IP languishes.

I just watched the video you posted and, as someone who's been an amateur board and card game designer in my spare time for about 20 years now, I know how much time and effort you've been putting into an idea with as much theme, backstory, and MATH as City of Heroes!

Do you know more about the legalities of the situation? Care to go into more detail? I'm not being sarcastic; this is a legitimate issue and we are slightly concerned about it, but we also have no specific legal experience. I'm not sure how else we could be more careful.

2. What you are doing goes beyond fair use.
3. If you were just a group of friends developing this to use amongst yourselves for tabletop gaming, nobody would be the wiser and more power to you. The moment you put it out on the internet, it's there for the whole world to pluck up, see and (eventually) use.
4. As I mentioned above, you would be seen as interfering with NCSoft to make any future profits off their "City of Heroes" trademark. It does not matter if the trademark languishes or if NCSoft currently has zero plans for the trademark.
5. Even if you had an actionable case and decided to fight NCSoft in court, they'd bleed you dry of money before it even got before a judge. And you'd lose and likely have to pay their legal fees.
I'm not a lawyer, but I do have a passable background in this area of law and the ideas of Fair Use.
I'm not trying to be a Debbie Downer here, but I'd rather not see people with good intentions get bent over backwards by a deep pocketed corporation.

Your best bet would be to continue with it, but to strip out all references to CoX. Make the 'offical' setting somewhere else, make your own versions of charecters similar but clearly different to people like Posi, and let us take the risks by setting the game directly in paragon.

The less commercial the use, the smaller the portion used, the lesser the import of that portion of the work to the whole, and the lesser the effect on the market for or value of the work, the more likely it will be that fair use doctrine will apply. The cheaper and easier it would be to license the desired portion of the work from the copyright holder, or the more valuable the excerpt to the work as a whole, the less likely it will be that your use will be determined fair. |
But I really don't want this thread to get bogged down in legal arguments, so what I will say for now is:
1) If NCsoft is willing to license the rights and the game is popular enough, we would totally be willing to pursue that avenue somehow. I find this unlikely, though.
2) We feel that our game is roughly within the same scope of fair use as other fan projects, fan sites, and fan creative endeavors.
3) IF there is a legal problem, we're not incapable of ditching all references to the City of Heroes IP and releasing only the barebones system.
I'm grateful that you guys are concerned for our sake, but for now the project continues on un-altered.

What NC would see is "Someone is using our IP. Distribution of a tabletop game set within our IP could hurt our future ability to sell products based on our IP."
Paragonwiki and the like are seen differently, as they are aids to using the IP in the form that NC can profit from. (Even so, all it takes is one harshly-worded letter, and the entire Paragon Wiki goes down.)
What you're doing here is offering a replacement.
It's a quite different thing.
Really, the best thing you could do to your project to keep it running would be to strip every last reference to City of Heroes out of it. Sure, you can still call your mechanics To Hit and Defense, those are generic. But every power and every archetype will have to be renamed, and all the villain groups scrapped and replaced.
Basically, even if you are not trying to profit from it, it could hurt NC's future sales. If they, miraculously, came out with a CoX tabletop game next year and tried to market it, its sales could be hurt because it would be competing with your system.
And, as far as the legal system is concerned, just because the IP holder isn't doing it now doesn't mean they won't in the future, so they have the absolute right to shut you down.
I am not a lawyer, your mileage may vary, et cetera.

We here at Great Forge Studios have been working on creating the City of Heroes tabletop role-playing game for the past few years, and we're in the final stretches now. I've recorded a video discussing where we are right now and how far we have to go before November.
