Retail Copies pulled?

If they are still doing hard copies and if so; have they pulled them from retail shelves (especially in non-game stores; like Wal-Mart)?

i would expect hard copies still exist, but they are rarer to find in stores because they more or less stopped with hard copies once the game went to the hybrid model

the most recent hard copy is going rogue

You could still find the Collector's Edition of Tabula Rasa in stores even a month after the game shut down and you could find copies of Asheron's Call 2's expansion pack for an additional year after the game was shut down.

Hard copies of City of Heroes may be hard to find simply because they probably stopped shipping them out awhile ago (when the game went F2P), but if you looked hard enough you could still find some. Most likely at stores that carry a lot of games.

Is it legal to sell software (at retail) that is essentially nonfunctional and lacking support (after Nov 30)?

Once they stop publishing and providing support for a piece of software, doesn't it become abandonware?

Still plenty copies of Going Rogue on Ebay. Considering that you can still find boxed versions of Neocron 1 out there (which was discontinued at least six years ago) i suspect there will be boxes of CoX out there for some time.

Not sure what you're really getting at here though. Are you looking at filing some sort of suit against NCSoft? Once the copies are sold to retailers it's up to the retailer to try to get their money back (something I can't see) or to remunerate the consumer for purchasing a dead item.

Who knows, it probably depends on what exactly they are "selling" you with the box. The software itself still technically works it's just the servers it connects to that are down.

Abandonware is generally defined as any software that is no longer being legally sold and supported which would be the case. However it's important to note that abandonware is NOT a legal concept. Even if NCSoft shuts down the servers they still legally own City of Heroes and all associated Copyrights (at least in the US, I presume Korean law is similar but IANAL).

The problem is that NCsoft would have already received their monies for the games on the shelf. The typical chain of retail runs like this:

Publisher (NCsoft)
Distributer
Retailer.

So it is up the retailer to pull any copies off the shelf, and then try to get the money back from the distributer, who then sends the copies back to NCsoft for a refund.

*edit* Kitsune is probably right about the store refunding the money you paid for the game back to you... As long as you bought the game recently from them.

*HOWEVER* I do believe that there is also a "shelf life" for the titles, so if the shop bought it in 3 years ago, and it is still on the shelf... chances are the distributer will not take it back. Rules vary according to distributer, but i believe that most will only take them back up to 6 months after purchase... (trying to remember back to when i worked for Gamestation).

Nope, that would classify it was discontinued. If NCsoft just did *nothing* with the game, and let it die a long slow death, and no updates (nor even servers for it) with no official "we are stopping this service" announcement, then yes, it could classify as abandonware.

*HOWEVER* that does not mean that it is now in the public domain. The company and creators still retain copyright over the title, unless they choose to no longer exercise their right.

I walked into a Gamestop to see if they had any time cards. They did and some CoX stuff. The problem is in the Gamestop database the SKU numbers has been pulled so even if the store has them in stock, they can't sell it to you. My best advice is go to Amazon and hope for the best.

I haven't seen any copies of CoH at Walmart in over a year. Basically since Going Rogue was pulled. Doesn't mean that somewhere it won't happen, because I can recall a case where hardcpoies of another cancelled MMO were still in the store past server shutdown.

Thanks for the replies.

I'm trying to find out so I can let my retailer know (assuming they still have it in stock and haven't been told).

And I was hoping the abandonware thing could work in the favor of those in our community looking for ways to acquire portions of the software.

I haven't seen a copy in a store since summer last year. It was also nearly impossible to find time cards outside of the holidays but I did still see the old game card at a smaller BestBuy.
