How big is the sphere? How high does the flying toon have to be to not get people below killed?

You see how wide it is by the size of the blue 'cracks' in the earth. Half that is the radius of the sphere. So, the effect is radius length high above you (if you stayed still and were at the center of the effect) and radius length below you.
So, even if the sphere was as large as 40 ft (as big as Steamy Mist's sphere of influence), then it would only extend 20 ft below you. If you hovered at 40 feet (a typical short range of many cone effects, e.g.), that give players on the ground 20 feet clearance of no effect.
Seriously, if any 'flyers' are flying and hovering with their feet grazing the heads of the foes below, then they're doin' it wrong. Just move to the distance of your shortest ranged attack and it will be fine.

....swore to never again run it with anyone who has proven themselves unable to follow a simple instruction. Don't fly high. People on the ground won't be able to see your blue patches and will get killed by them. How hard is that to follow?

I run it about every other day. On my Dom.. hovering above BM spamming Ring of Fire and my longer ranged blasts. I have it down to about 1 death by Blue.. I find I die far more to the damn Hydra in the sewers. Honestly Apex is not that hard, and its fun as heck.

Either method works fine. It's the middling distances that tend to get things very muddled. Another thing to be weary of is your distance from the target vs distance from the ground. Forty feet directly above the target is fine, but if you're firing at an angle you're no longer a clear distance from the ground. If you're using the shortest range attacks (Blaze, Power Burst, etc.) make sure you're directly above the target.
The "patch" is a sphere. It is not columnar.
You can get hurt being under one if it's too close to the ground. But you can easily get to the limit of your blast powers and leave lots of room for others to run underneath them. I've never had someone on the ground get hurt for being under the BRoD that spawned in my flight path. The "do not fly" rule is unduly removing a excellent survival mechanism for squishies who would melt under Sword bosses. Swords have no ranged attack. The ranged attacks of the Champions have no mez. Flying is a huge benefit to ranged ATs. And if they get hit by a BRoD, the -fly drops them out of it to safety! |

I've never heard of the "no flying rule" before, and I've been running a lot of ATFs. All my squichy 50s have fly as a travel power. It's a great mechanic to avoid the flying-swords-that-can't-fly. Flying high has also saved my life on 2 occasions where I was slow dodging the blue patches. They have a -fly component, so it actually knocks you out of the air and underneath the patch to safety. Well, as long as you don't land in a group of swords anyway.

...started worrying about Numina and how the hell I'm going to be able to get through that boring, annoying, slow stupid dummy Task Force.
realised how much I hated this TF when running with min graphics and now how much I love it when I can run it in ultra on my new machine. I didn't even know they were falling swords before.
Also how much I hate anyone with blue coloured location powers. Seriously don't cast Freezing Rain (I think not an expert on storm powers) or Ice Slick, how am I supposed to spot a blue glow under that?
- really started hated Hydra, especially when they are found within the sight of a Pylon.
Highly unfun part (on my Scrapper at least) of an otherwise great and enjoyable TF.
Yesterday I completed my first Apex run without dying once. I was proud.
Cursed the radiation emission defender who had coloured his rad-fields blue.
