Severance Package
I believe those clauses are not enforceable or even legal in California.

I doubt there's a no compete clause. Zwill said on his last video that NCSoft threw the employees a job fair, so I'm thinking even if there was one, they're not enforcing it.
This might be a bit naive, but I would assume that such clauses apply if you leave the company, but not if the company leaves you?

Normally it would be as a direct competitor, so CO/DCUO or another MMO. However, there is more to life out there than MMO's and I know of an ex Destination Games person who started work with Disney on Epic Mickey soon after he was let go (another started work at NASA IIRC).

This may just be wishful thinking, but I'd think that as part of any severance package the devs got there would be a non-compete clause. And if that's the case, there would be a timeframe during which they couldn't take employment with a competitor or work on competing material.
If that's the case, mayhaps there's more time to reacquire the dev team than people are assuming? I don't know. Can they just start getting hired right away? |
Can they hold you to a non-compete clause, if they lay you off?
If you quit, I can see it. If they lay you off though, I don't think they can hold you to that, as it leaves you without job options.

But of course, enforceability is always the issue.

Secondly, with MMO design being a relatively narrow field, that makes it even more unlikely.
