there is more than one comic character with retractable claws that come out of their hands... but only ONE with three claws that come out the top and go snikt... hence the obvious similarity between CoH's claws and Marvels. (I maintain that if cryptic would only increase or decrease the number of claws on the hand by 1, there would be no more problems.)
There are also numerous characters who can manipulate magnitism or magnetic fields, so as long as the magnatism AT does not come prepackaged as part of a SG called the brotherhood of evil... people and with a lacky named toad, i think we're OK on that one.
And as per your line of reasoning, wouldn't plant control be out of the picture, what with poison ivy cornering the market on that one?

The Teen Titans fought some magnetism-using baddie (Polaris?) so DC has one, too. For Gravity, I can only think of two Marvel villains, some dude the X-Men fought early on and that Brotherhood mutant who died of a heart attack when they teamed with X-Men to fight that super-Sentinel. Assault Rifle? Only the Punisher comes to mind. Etc.
So I don't think they're too concerned. After all, with the plethora of superheroes and -villains the various companies have come up with (esp. X-Men francise for Marvel and Legion for DC), there's hardly any idea that you cannot say hasn't been covered by Marvel, DC, Image or Dark Horse, to pick the four big superhero publishers. So either you give them the rights to the entire concept, or you say that it has been so diluted there isn't really any defensible uniqueness to protect.

I really, really hope minions make the first release of City of Villians and they have their own "minion customization" system. I remember an old interview when they mentioned how City of Villians and villian play would be an expansion (this was before it was announced) and some said "If we're going to do it, we're going to do it right" so they'd focus on heroes first. Later someone brought up the topic of minions and they said "Oh, definitely. Like I said, if we're going to do it we're going to do it right" Viva La Cryptic!

And Wally West has a crazy ex-girlfrend with magnetic powers, who goes by the code name of Magenta... dunno if she's still around, but last time I read a Flash comic she was causing all storts of trouble behind the scenes.
Without really trying all that much, I've seen the Paladin under construction and in completed form, the Octopus and the Ghost Ship.
So far, I haven't actually seen the Ghost Ship dropping any of the little ghosties, I've just seening leaving Talos a couple of times.
I think over time people will tend to see them. They aren't really all that rare. It's just the luck of the draw.
