I never have signed up for or tried a trial of any other MMO because im not interested in their genres, or the stories I heard around school of cheating/hacking/being 'modsmacked'/exiled from your group because you couldn't play a 48hr shift with them.
The laid back openness of our devs is one of the major reason people continue to play this game, feeling like our opinion matters is a great assest, when devs go 'to hell with your ideas' people tend to get angry.
Of course everyone here will now tear me to shreds for this, but the opinions of the 10 most active forum members, and the actual in-game players tend to tip opposite ends of the spectrum. Its too bad the devs don't see the opinions when the same topics are brought up in-game

Here are reasons *why* moderator/GM actions are not allowed to be discussed on this forum and the overwhelming majority of forums:
1. The officials taking official action can not publicly denounce a person and lay out all the things they did wrong and all the warnings they ignored. Whether rightly or wrongly, they'd be sued for defamation. They can not trash a person to justify their case. They just can't. Which puts them into a bind because...
2. When a player wants to discuss moderator actions, they're looking to 'try' the case publicly. But if the mods can't defend their actions publicly (see point 1 above), then they will always lose such public trials, even if they're in the right.
3. People who have no business in this matter get involved: Friends of the person who had an action against them; people who have an axe to grind against the mods/devs for some other reason and all of a sudden they become a champion of justice for someone they don't know and over a case of which they have no facts; and those who are simply anarchists and are willing to 'take the man down a peg or two' so they can do whatever they want without consequences. There would never be any satisfying answer given to these people, even if the mods/devs were allowed to explain their side fully.
Actually, when someone starts trashing a mod/GM/dev for taking unfair actions and they have no real basis (or even the facts of the matter) to make those claims, I'd like to see them get slapped with a defamation suit instead of simply having their thread deleted. Then maybe we'd see people be a bit more understanding why the mods/GMs/Devs can't divulge the details of the censures they enact.

Actually, anyone can sue anyone else for any reason. The real questions are: 1) Is it worth it? and 2) Will you win? (perhaps a subset of 1, but some curmudgeons sue even with no hope of winning just to make a point).
No one will ever win a defamation lawsuit against a company that truthfully lists a players transgressions. Lawyers generally only file lawsuits if they think they can win something or at least have a good enough case to force a settlement.
The remainder of your points are probably accurate though. They may not be legally required to refrain from commenting, but it's usually a good policy to keep those conversations private. Those discussions usually end up in flame wars that accomplish nothing but getting more feelings hurt.
On the other hand, I think it IS good policy for the company to discuss their policy or philosophy regarding discipline, including aggregate numbers. For example, I think it would be OK for them to state (with my own made up numbers):
"Recently we took disciplinary action on 157 accounts that had engaged in exploitive conduct inside the mission architect. On further review we realized that we had mistakenly disciplined 15 accounts. Those accounts have been fully restored, compensated, and have our sincere apology for the misunderstanding. We are reviewing our internal policies and systems to ensure that those errors are not made in the future."
I would appreciate seeing a post like that. I'm sure others would as well; and a bunch wouldn't like it all . . . like most things in this forum.

I would be one of the ones that would greatly appreciate a note like that being made. Some note, something that let the playerbase know that while they made a mistake in handing out punishments they learned from that mistake and will try to not do that in the future. Its really that simple and it would have done a lot to make the playerbase feel better about what was done.

A lawsuit is merely a formal accusation and a claim for relief. There are some procedural hoops and some costs involved that keep it from getting too out of hand. But yeah, it's scary what someone with a little knowledge and an axe to grind can do. (Look up Jack Thompson)
And if a lawyer or citizen files frivolous lawsuits they can be penalized several ways, including monetary sanctions, prohibition from filing future lawsuits, and loss of license for the attorney.

That's really my biggest issue with the whole thing - they said they'd be handling each disciplinary action on a case-by-case basis, and then somehow managed to hit people who hadn't done anything wrong... then rather than admit to it and take responsibility they just try to shove it under the rug under the cover of "not talking about disciplinary actions" and deleting any thread talking about it, causing a large crowd to just blather on about how superior they are and that "if you got banned you're an evil dirty cheater, because the devs never got anyone that didn't deserve it".
Honestly, the comments from the rabid anti-farming players are far more harmful to the community (and continuity) of the game than the actions the devs took or are taking - complete with the "shut up and go away" posts that are oh-so-helpful (and in my opinion should be banworthy themselves). But the devs made a mistake and should own up to it, or at least give some (empty or not) promise about how it won't happen again. All it'd take is a simple post like the example you provided.
So can we get to talking about unmentionables now and stop all this forum nonsense?

I can see how people would like to see something like that. But, honestly its none of our business. Any disciplinary action taken, even if taken mistakenly like some have claimed, has no bearing on anyone but customer service and the customer concerned.
For example, me and my niegbhor both have ATT wireless. My niegbhor tells me his cell phone has been shut off. I have no idea why unless he tells me. ATT should not have to send me a letter explaining why my niegbhor and X number of other people have had thier phone shut off. Its none of my business and expecting them to let me know about it is ludicris (I am pretty sure I spelled that word wrong.).

The difference between AT&T, and this game is that this game has a community that AT&T does not have at all. City of Heroes is an MMO, lots of people who interact and enjoy the same game builds a community in a way that individuals using cellphones does not.
I don't want to know exactly what the disciplinary action was, nor do I want to know who it was taken against. I want to know that the sloppy way that the punishment was handled will not happen again and that they have learned from their mistake and players who have done nothing wrong don't have to worry about getting a temp ban for no reason.
When AT&T (or any other business) accidently "loses" customer account info they usually send a letter to everyone informing them of what happened, how sorry they are it happened, and the steps they have taken to make it up to you and to prevent it from happening in the future.
They do this whether your particular info was stolen or not.
