Actually you can be sued pretty much for anything here. There was a memorable case of a psychic sueing a MRI facility claiming the MRI deprived her of her psychic powers.

She lost.

OP is correct on the issue of copyright but in this case the characters and names are usually trademarked.

As to who won in COH vs Marvel who knows ? It looks like COH did.

Then, to be blunt, the person you should be angry at is the OP. He's the one who showed up here yelling that a great injustice had happened to his friend. He was demanding sympathy and outrage for a story that did not add up when compared to the experiences of, oh, pretty much everyone else this has happened to.

When presented with a situation that is far outside the norm, naturally people are going to want some sort of proof or explanation as to why his friend's genericing was treated in an unusual way. Getting huffy over it makes no sense, since the OP asked for it. If he didn't want his story to be questioned, then he shouldn't have posted it.

Well, considering the OP is a friend of mine as well, I may be somewhat biased; though I honestly believe this probably should have been handled a little more discretely.

Requesting evidence is one thing, but Lunchbox's posts are demanding evidence "or else" and that is another situation entirely.

You're right, he doesn't have to. But he does because he doesn't want to tick anyone off. Most artists have been good humored about it and said yes. A few, like Prince, have said no, and he's respected that. And then there was James Blunt, who said yes, Al recorded his parody "You're Pitiful", and James Blunt's record company stepped in and said "no", so Al left the song off the album and instead shared it for free via MySpace and YouTube.

I need to make a correction. I have no clue who the OP is, it is not the player I thought it was, furthermore they really should have gotten Nexus' permission start this thread in the first place.

I will continue to defend my friend to the fullest and reaffirm the fact that the deletion did happen.

I have never heard of a toon being deleted after being genericed. Could this be an "abuse of Mission Architect" deletion being misrepresented?

People get hot and bothered over strange things sometimes. Just yesterday I had someone quit a task force in fury because the character was exemplared and not getting exp and the player felt that no one had mentioned that. Despite the fact that I'd been spamming a task force invite text that mentioned level range and explicitly added "above X will be exemplared, but still get merit rewards." The other players tried to calm this person to no avail. So, a situation in which one player suddenly INSISTS something happened or did not happen, when everyone else present knows otherwise, is quite possible.

I think that when someone is really emotional, it's somewhat more possible there's some aspect of the situation they're not fully understanding. That's just natural.

Has this been escalated to a supervisor of the GMs? They do that, you know.

I assure that we do not fall under the Bat Guano Crazy category. I am fairly certain it is going to be escalated tomorrow, as this is a holiday today and everyone seems to be taking the day off.

Posting here will accomplish absolutely nothing - none of us can do anything about it.

A character can and will be generic'ed for name, costume, and or biography. That is their right to do if they feel it should be done.

I had a character's name get generic'ed after playing it for a long time and hitting 50 as well, so don't think anyone is being singled out here. In my case, I asked for it to be escalated one time, that supervisor concurred, so I left it at that and changed the name.

Not a huge deal, unless you make it one.

Hooooowever.... is this reason to stop enforcing the EULA for the transgressions they do detect? A crime unseen is a crime that never happened? Or should they start hiring Brazilians to check all Portuguese-based offenses?

C'mon. The only reason some criminals are happier than others is that they haven't been caught yet. And everybody knows the penal system (anywhere, everywhere) is full of saints and "people-who-did-nothing-someone's-after-me!".

Contact the support and try the right venues for problems such as this. Then, if everything else fails, do the /ragequit.
