If a buyer signs on the dotted line with that stipulation they become solely responsible for the infringement and the actual responsible party walks away free and clear.

That is exactly the point. NC$hit is trying to get someone else to take a bullet for them.

Shutting the game down won't protect them though, they are still on the hook for any litigation that arises regardless.

It's a lose/lose situation for them. Sell the game without that stipulation and they could be sued (has there ever been a suit filed against the CoX IP?). Don't sell the game and the PR disaster continues to escalate. Sooner or later investors are gonna want to know why the companies profits are down.

Selling the game without that stipulation would appear to be the lesser of two evils. They make some money off a property that is currently making none and put a stop to all the bad press. Yes, there is the outside chance of a lawsuit, but as I asked up above, has there ever been a suit filed against the COX IP?

Sounds like the people that was looking to buy didnt want to take any risk and expect NCSoft to hold the risk in something they would no longer own. No wonder NCSoft held on to it. That is assuming what is stated above is and were to be the case. No one wants to be sued over something they have no control over any longer. It's like if they did recieve a C&D order over old content and NCSoft contacts the new company and say remove said content but new owner refuses and thus NCSoft gets sued. No risk to the new owner.

  3. The damning stipulation was that the new owner would have to assume full and sole responsibility for any and all future litigation against the game. Even if that litigation was brought about by material added to the game at the direct order of NC$hit.

Who in their right mind would agree to that?
  4. There has been some info out of Titan that explains why buyout talks failed.

Do a little digging on Titan and you can probably find the info in question.

The Cliffs Notes version is that price was never a problem. Certain other requirements set by NC$hit made buying the IP a very unwise and high risk financial/legal decision.

After learning of the above requirements, I can't blame anyone for not being willing to sign on the dotted line.

How do we get the Devs and other staff members to start their own company with their own IP/game/etc?
Point me at that Kickstarter and I'll do something extreme to a credit card.

    Done.

This could be a great piece on the power of a mostly ignored type of social networking. FB and Twitter get a lot of attention. MMOs not so much even though there are millions of MMO gamers out there.

    I rather like that image.

    Thanks Victory

Thanks for all the great memories Victory. Hope to bump into some of you again some day.

    Death Emotes

    This could be fun.
  12. The Super Pack situation is a very simple one for me.

I will NEVER buy one. Anything that is available exclusively from a store purchased grab bag is something that I will never have.

I don't spend money unless I know exactly what I'm getting for that money.
  13. First DXP in a while that falls on my weekend off.

    New Judgements?

Personally, I'm hoping for options that are unique to the HEATs and VEATs.

    Wish List:
Photon Seeker Swarm (Peacebringer only). Ranged Targeted AoE. Summons 2 Photon Seekers per tier that detonate on the target with an increasing spherical AoE per tier. Also has the usual Luminous Blast secondary effects.

Total Eclipse (Warshade only). PBAoE that combines the Warshades self buffs and target debuffs into one massive attack. Also has the usual Umbral Blast secondary effects.

Omega Cluster Bomb (Bane/Crab Spider Only). Ranged Ground AoE, as Photon Seeker Swarm but with the mesmerizing effects of the standard Omega Bomb. Damage and Mez radius scales up per tier.

Not sure about the Widows, haven't played them enough to get any good ideas.

Anyone else have some suggestions for the Devs?

    New Judgements?

Hey Devs, any chance of new Judgement powers sometime soon?

The current selection leaves out a lot of the basic powers in the game.

If you don't like teaming then tough because your option in I20 will be Trials. IE like the Cathedral of Pain Trial.

We haven't got any mechanism planned for i20 which allows you to solo to get top tier Incarnate abilities. In fact we haven't really thought about any content for them at all.

    • If you can't team because you may need to afk/leave quickly - tough.
    • If you want to be in a small team - tough.
    • If you or your computer can't handle a Raid or Trial - tough.
    • If you actually want to play rather than sit around waiting for a Trial or TF to be organized (and I am looking at you CoP Trial) - tough.

So basically you're confirming here that solo'ists and those who prefer small teams are out of luck.

    Lovely.

Those 'soloists' ARE multiplaying but not in the way seen by your limited view.
    • They're interacting on the market.
    • They're interacting in chat; especially helping people because they CAN stop and explain which you can't do if you're in a fight on a TF.
    • They're probably telling their friends about the game who may well be a different element of your player base.

I am not a rabid solo'er. However, I do solo and I would like to think I can work on my Incarnate stuff when I am solo'ing. I don't want to be forced into doing eight Trials to advance because frankly I might as well log out for the period it takes to set them up; at least I'd be getting credit on my day jobs.
I agree with this totally. It is beyond stupid for the Devs to shoot themselves in the foot with this (apparent) decision.

    Launcher Freeze

Since maintainence on Dec. 16 my launcher freezes and stalls my system every time I try to start the game.

I have tried Live and Test server and get the same results.

    Anyone else having this problem?
  18. Oh great and wise Devs, we beg that you see fit to grant this request and place a Vault in
    Grandville.

Really, I'm surprised there wasn't one from the beginning.
  19. 'Victory Forum' actually, with the MOTD by you Ham.

Edit: Its working now actually, not sure what happened earlier.
  20. Yep, I wasn't seeing any chat in the channel either.

I check it over again when I get home in an hour or so.

Sorry, should have specified 'Victory Forums". I tried sending several messages to the channel and got nothing.
  22. Joined channel as @Tam-Rael, looking forward to teaming with you all.

An unsilence would be helpful as well :-P
  23. All my unused but available character slots disappeared as well.

Not a good thing to happen right after launch day.
