What I find funny about these fights over the law is that none of the real life lawyers that I know who play this game, ever comment with such certainty on legal matters. There are far too many variables to be sure how this would play out. And I wouldn't even start the research to render an opinion for less than a $1000 retainer.
Edit: if any one is interested, PM me if you're in Illinois. -
No need to feed trolls on a fansite.

Quote:You must have never went to college then? Because there's none I'm aware of that let you get your degree (or even start a class) without getting paid.Even if you guys get your refund on advanced time, hopefully you'll learn it's not always wise to pay that way for online entertainment. Because, technically, you got what you paid for and aren't entitled to anything in my eyes. Paying for a service before you get served (and isn't a reactive service) is like tipping your waiter as you walk into the restaurant.
You must not have ever went to a major market team sports event or concert. Last I checked, you paid, sometimes months in advance for a ticket.
I could keep going, but your comment is absurd. -
Quote:Good news there is that in many states corporations cannot defend themselves except through a lawyer. So they would have to pay something. And even if NCSoft lost the only legal fees they'd have to pay is the fee the plaintiff spent to file the claim.
They aren't going to pay attorney's to fight a lawsuit over $15-$200 bucks. If anyone actually shows up it'll be some local employee with a copy of the EULA and the reimbursement they offered. -
Quote:That works both ways. In nearly any state, the fee to file a small claims matter is more than its worth. And with the venue provision in the EULA it is likely to be dismissed summarily unless you happen to live there.1. Most companies give in to any small claims legal proceedings immediately. Why? Because the legal costs of fighting it are almost always higher than the actual claim, and companies don't care about fighting things on the "principle" of the matter.
Quote:2. Not everyone lives in America with your crappy legal system. -
Quote:Sadly, they may be counting on it. Free money for them.I'm lucky enough not to have pre-paid any months; I just leave my card on autofire. It is complete B.S. to give someone who might have purchased up to a year ahead of time, for example, "NCSoft credit" though. Do they not realize that the majority of us will never touch another one of their products again?
-
Quote:I agree. I think this is a done deal. So be it. All you can do is never allow this company to do it to you again.Studio is permanently gone - they are getting new jobs, and that won't stop. I have a strong feeling that anything anyone does won't make any difference, including Titan's shenanigans. I want this game to continue but I'm realistic about all efforts done with other MMOs that have been killed and the results that usually follow (I said usually.)

Quote:Exactly, hence why I shall not give NCSoft's Arenanet division any more of my money. That Arenanet is in the same subsidiary boat that we are/were in. NCSoft caould have just as easily pulled the same stunt with them as they did with us. They didn't choose to tank Paragon Studios, the {pancakes} in charge of NCSoft Corporate did.
It's perfectly reasonable to choose not to do business with NCSoft anymore, but please let's try to focus any negative feelings on the ones actually responsible for making the decision.
Arenanet's already getting punished financially for something they didn't do because of NCSofts decision. -
I'm not opening a ticket. They need to tell me what they intend to do. This is THEIR action.
Now if you plan to come back with some nonsense about me not wanting to fix the problem, please don't bother. You're right. I don't want to fix NCSoft's problem. I expect them to. -
Quote:I don't either. And I'm in the same boat. Already bought the game. Will play it casually. Will never buy any gems or expansions. And there's nothing wrong with that decision. Had I not bought the game over a month ago I would be doing the same as you. But since I can't get a refund I'm not going to turn my pre-purchase of GW2 into a gift by not playing it. It's not CoH but I don't hate the game.

Quote:What the goat said.If a dog that has previously been pleasant and friendly suddenly starts growling and biting, my attitude toward that dog will immediately change.
I will still have my memories of the dog when it was more amenable, but my attitude toward it will be driven by current behavior, not nostalgia.
The past is gone, and NCSoft are presently destroying my online home.
If they want my good opinion they must radically revise their current behavior. -
-
What free three months? I'm paid up through May 2013 and NCSoft has given me no indication whether they intend to issue refunds.
-
Quote:No. Why would it be? I don't know what happened to Tabula Rasa. Other than it shut down. I'm looking directly at how NCSoft treated ME as a customer HERE. I'm not happy that the game is shutting down, but these things happen. And isn't it just mildly hypocritical to boycott or otherwise demonise NCSoft for their practices because it affects this game, but not boycott when they've done similar things in the past, up to and including the very nasty situation with Richard Garriot?
What I am absolutely livid about is how dismissive NCSoft has been towards us. It's been over a week and we still don't know what happens to our subs if they go past November. We get no 'end of game' activities because they fired the whole dev team and put us on maintenance only. Even SOE for all the crap they take, shuts down their games with respect for the players and events to commemorate the game. NCSoft, doesn't think we're worth the bother.
WHY IN THE HELL WOULD I GIVE THEM MORE MONEY?
Quote:The business is not a person. I'm very sad for Paragon Studios, the community of the game and the game itself, but I can't in good conscience demonise ArenaNet for doing business with NCSoft. That's guilt by association, and ArenaNet are bending over backwards to provide a compelling, funny, thrilling and overall fun experience.
Quote:But please don't take your personal bias, your personal prefences and most importantly, your personal hatreds or peeves out on a game that's just started. Because I bet this game got that and more. GW2 is doing a lot of stuff right that games before it did wrong. And it's even borrowed from this game and ensured that the journey is something you can enjoy with your friends at any point during it. Remember that. They didn't pluck that out of nowhere.
Respect it on its own merits, not some other games'.

Quote:So?The 'boycott' thing is really cute and humorous. They have sold so many copies of Guild Wars 2, that Arenanet STOPPED SELLING IT to make sure they can appropriate resources to servers first. You aren't affecting anything - they won't notice it at all.
...not only that, but didn't someone just show how CoH was only 2% of NCSoft's income for the last several quarters? Do what you have to do - only realize it will never affect them in any noticeable way.
I don't want to support NCSoft or their products. I already purchased GW2 and don't find it to be anything special. I see no reason to support a company with so little regard for its customers. -
Quote:Zwill (assuming you read this), could you please pass along, from a customer that paid for a full year of service, my dissatisfaction. Not just that this is happening at all, which I'm upset about (as evidenced by the fact that I like the game enough that I was willing to subscribe for a year) but, specifically, at how poorly this has been handled. I understand that sometimes businesses make decisions that customers aren't happy with but NC Soft should have had answers for questions like this ready when they announced the decision.Quote:This still sounds to me like a desesperate action from NCSoft.
Just shutting down, firing everyone off and kicking devs and players out of home.
There was no organization, no talks to the studio to see what could be done, or in case the decision is definitive, no way we can know what happens to our Paragon points and suscriptions.
Here we don't even rate that consideration. -
My three favorites?
Hmm...
1) Kyll - My BS/Regen, my first character, first 50, first AV killer. I have two boys, if my wife and I had a girl we would have named her Margaret Laura. We didn't, but I did have Kyll, so I gave her that name. She's designed to look like my wife, but has my sons complexion (my wife is white; I'm black). Kyll is my connection to this game. Quite literally she does everything first. She's the first I take on new content, the richest character I have, and she forever will sit at the top of my character list.
2) Sassy Succubus - Claws/Will Stalker - She's flawless. I love her look, her powers, her feel and pace of play. I guess she would be slightly better with Spin, but she feels as natural as Kyll to play with 1/50 of the playtime. And everyone loves her backstory. I get more compliments on it than any other.
3) Dragon Gecko - SS/Regen Brute. Dragon Gecko surprises me. Everytime I log into this character, I'm like "When the hell did I do all that?" The character is well down the path of the Incarnate, and he's the second fastest character I've gotten to 50. He's a beast and a brute, but his expanded back story is one of the better I've written. -
Quote:I had to look up what IANAL, probably because I am a lawyer![*]Private server possibility? "IANAL", but probably not legal.[/LIST]
Thank Obsidius. After reading this, my hope that this game will get a reprieve from execution is pretty much dashed. Not interested in a private server even if it was feasible.
I'll probably be gone by the end of the month, only logging in on the last day to say goodbye to my angel. -
Quote:I would no longer play. My angel, my BS/Regen dies and my connection to the game is so tenuous that I would no longer feel compelled to play.I'd love to make this a poll, but can't find how, so I'll just ask.
If all your characters were deleted, your veteran status, everything (even forum posts), and you had to start from scratch, would you still continue to play this game, or would it be too much of a setback? -
I'm most interested in the Battalion and the further Incarnate war, specifically:
1) What did the Battalion look like? Who were their leaders? Was their goal simply conquest?
2) What were the tenatative plans for Genesis, Mind, Vitae and Omega slots?
3) Were there any plans for characters to ever 'ascend' like Rularuu?
4) What is the group that Prometheus belonged to? What was their goals and motivations?
5) Is Mender Silos good or evil or neither? It seems like Nemesis might have recognized the folly of his ways in his VERY old age, is that true? -
I wouldn't pay more than the industry standard for a sub ($15 month). Not because I think the game isn't worth it. But doing so isn't a sustainable business model and the game would atrophy.
-
That's what I assumed. Given that NCSoft financed the game's development, I can't see any reason they would have ever agreed to a limited license.

For regular content, not super high end feats and farming, I don't think it much matters. Any/Any works just fine. These are Brutes we're talking about.
