That's from an actual gathering organized by a community manager. The white fairy in the front is Niviene, I think. I am the blue dude flying with rocket boots in the middle right. It was most likely released as part of a press kit.

That looks like one of the official Test or Beta server screenshots from a couple years ago.

Although, I don't think that location actually exists in-game. It might be a combination of two different shots.

I think you might be thinking that because what you're looking at is the OLD Atlas park and it's style of buildings in the background as opposed to the new version.
So technically no. It doesn't exist anymore in the accessible game.

There were never stairs like that near the Atlas statue. And you could never see an AE building from that angle. It almost looks as if Atlas has been placed in Galaxy in place of the Arena. And now that I think on it, if it *was* Nivienne who took it, then that's where we were: Galaxy City.

It might be the case that NCSoft may own the characters and images, but we still have some usage rights to them as well.

It's probably fair use. You are reproducing a small portion of the game for public news with no financial gain to yourself.

I thought that was the screenie that Niviene arranged for one of the anniversary stories on the NCSoft page and also as a press release.
If it was already in a press release, wouldn't that make it as least semi in the public domain?
I suggest contacting Zwill to see if this was the screenie taken at anniversary in either April 2012 or April 2011 - I can't remember when Niv left, although it should be searchable here as an announcement, which I ca't do right now since I'm at work and it would take too long (hate the search function on this forum).

You forget, something like this is what they'd have to ask their legal department about. And they no longer have a legal department (Zwilinger stated as much in the latest Twitch.tv broadcast, as a reason why no giveaways could be done before the shutdown). So, nobody who's left on Paragon Studios can give a firm answer on this.

That appears to be the screenshot used for the 5th Anniversary promo material. If so it was taken on the Test Server in AP in the late afternoon (Pacific) April 23rd, 2009. Not sure if that helps any.

whoever took it didnt just hit printscreen as there are more heroes in that shot than the client will show you. you can only see the closest 100? heroes to you in game. here are the two i took at the same time and you can see that not everyone is visible.

It was most likely taken by David Lewis, our internal guy at Paragon Studios. For shots like this, he actually just used demorecord.
He would fly slowly with demorecord to take a group shot, and then parse through the demorecord file to:
1) remove any characters that may have had an infringing costume
2) remove characters that artistically weren't fitting (i.e. for a screenshot on a retail box or a screenshot for Marketing / PR).
I remember that we occasionally would have to remind players to stop using certain emotes, or stop using powers during these screen capture/demorecord sessions. One time, there were two instances of Atlas Park, and when the group in Atlas Park 1 was getting too uncooperative/rowdy, we just used the group of players in Atlas Park 2.
