Actually (IANAL) the EULA does not give NCSoft ownership of characters made with its' tools if you already own them. It gives them the right to use them.

Therefore, if you make up Trademark Man and go on to make millions off of him, NCSoft does not get a cut, but they can put Trademark Man on the cover of their boxes and on the website, put him ingame as a trainer, etc.

Of course, if you are, say, Mercedes Lackey, and you make a version of Vanyel in the game, NCSoft isn't going to risk litigation by immediately putting him in Azuria's spot. More likely, they are going to generic Vanyel and make you choose a new name, bio and maybe costume.

I hear this actually happened, in this game, to the guy who writes the Dresden files books.

Thank You guys for some serious Answers. Gave me a lot to Chew. I'm going to leave Red in my Story Arc for a while and see what happens, or until a red name pops on here and makes a comment. The Player character himself though no reason in getting him back from Support, I can just recreate him with a new name and save the trouble.

A name *OR* costume can be found to be infringing and get generic'ed. You do NOT have to have a name and costume combo for it to infringe. So you can't make a hero named Spiderman with a green and orange costume.

I was under the impression that it operated on a 'two out of three' system of Name, Bio, Costume - if two of these are breaching the EULA then that dude's getting genericed.

Then there are basically no names at all we can use, as I can guarantee unless you're going to make up a nonsensical string of vowels and use that as a name, it's likely there has been some fictional creation with that name. Particularly hero names.

Essentially yes; so be nice to your teammates, so they don't report you. Many toons are probably a Google search away from being genericed.

Of course, then there are also the public domain characters. We can all play Dracula, The Wizard of Oz (from the books not the movies) or (in the EU)Peter Pan...

Also, everyone should totally make a Jenny Everywhere toon.

You're guaranteeing that something is 'likely'? I think you misunderstand the meaning of AT LEAST one of those words.

Anyway, my statement that you can get generic'ed for an infringing NAME, independent of the costume, is correct and your 'guarantee' is hot air. Maybe the English language has more words than you realize.

I also created one. She's also part of Union RP now :P
Unfortunately, due to Nemesis, she has to recognise him due to him being everywhere, but that's the wonder of universe shifting too. Also, Jenny Everywhere was free
