CoH footage on YouTube - Usage rules?

I got some game capture software for Christmas and was hoping to use it to record City of Heroes gameplay footage to upload to YouTube. I was curious if there were any rules/guidelines/agreements/whatever in regards to setting the videos up for revenue sharing.

YouTube requires that you either explicitly own everything in the video, or have permission to use content in the video in order to set it up for revenue sharing.

I'd go ahead and guess that you won't be able to earn any revenue off of anything CoH-related. According to their page explaining what can and can't be used, video games are listed under NOT eligible here:

Your video is not eligible if it contains content that you didn't create or get permission from its creator to use. You need to be able to show written permission for the following video elements:
  • Audio: recorded music, live performances, cover songs, background music, etc.
  • Visuals: images, logos, software, video game footage, etc.
  • Any other content you don't own worldwide commercial usage rights to.
So unless you can get permission from NCSoft or Paragon Studios (or whatever), it won't qualify.

Well see Microsoft games such as Halo are under a thing called simply Microsoft Game Content Usage Rules that state as long as you abide by certain guidelines [basically just copy/pasting a bit of text stating and linking the usage rules] you're allowed to use game footage, music, etc. in your content. I was curious if CoH might have anything similar.

As long as you don't make any money from it, and the only thing YouTube makes money from is the ads they display on ALL their pages (or whatever other host you end up using), you can do pretty much anything.

If you want to make money off it, you can't use City videos.

Yeah, I've got quite a few out there now that I made from my Mission Architect stories and when specifying the type of license, there is that restriction referred to earlier that you would need to own all content. In my case, I ended up using music from CDs I purchased so it was also limited in that way, however, I know Youtube also has its own music you can apply. But when you do, it overrides any sound effects you may have already in the video (e.g. sound of tank stomping on someone).

Also, you are limited to 15 mins initially but I think once I got past I think it was 10 videoes (might be less), it now lets me put up longer ones (got a few that are 40 mins, etc.

As an aside, what software did you get? I've been using Microsoft Live Movie Maker which definitely has some drawbacks so was looking for something a little more polished; would be interested in your experience with the software you purchased (and how much it cost).

A better person to ask would be either Zwillinger or Black Pebble, since they work for Paragon Studios, and if they don't know the answer themselves, it's a sure bet that they know who to ask.

I got Roxio Game Capture. It seems useful so far. It lets me record game footage and then has an editing program built in that [at first glance, at least] seems very similar in function to Movie Maker. Haven't really gotten to use it much yet.

I'm trying to lay my hands on the exact PM I'd gotten a while back from Lighthouse and/or Ex Libris re: me posting videos to YouTube of game footage, but crediting COH/NCSoft/Paragon Studios as the source of the video footage is sufficient for posting vids of the game on the internet PROVIDED that:

a) I am not violating an existing NDA
b) I am not profiting off the video (i.e., I can't 'monetize' it), and
c) I am not defaming the company, the IP, or the game itself via the video.

That at least covers VIDEO footage (and sound recorded from in-game). If I add unlicensed music, then I run the risk of the music's licenseholder yanking down the video for their own separate reasons.

I will update this post if I can find the original PM (it was pre-board migration so I don't know if I still have it).

Ah alright. Thank you Samuraiko. I had a feeling it would be something like that. I've only posted two test recordings so far trying to figure out optimal quality settings in my software but didn't try to monetize them and gave Paragon Studios and NCSoft credit for the game.

I just wanted to know for sure if it might be allowed. Now that I know it isn't, I can at least rest easy knowing I can still post the videos as long as I don't monetize them.

A suggestion once you've progressed past the basics of Windows Movie Maker (or near equivalents) is Sony Vegas Movie Studio... I use the HD Platinum edition and absolutely love it. You can make some really sweet videos with it, and it's a nice stepping stone between the uber basic WMM and the high end software.

When I can afford it, I plan to REALLY upgrade and go whole hog to Adobe Premiere and Sony Vegas (yes, both of them).
