Hey, I'll make a character with flamey boots and you can say they're my character's boots. That way they're definitely not ambiguously maybe possibly perhaps Bayani's boots!
In fact, with over a hundred characters, I probably already have a character with flamey boots.

I look at it like this: It's a pair of damned boots. It could be your boots, or my boots, or anyone's boots. What it's *not* is a likeness of any one character, nor an iconic emblem of any one character. It's just a friggin' pair of boots!
Heaven forbid someone put a pair of sunglesses with red lenses in a picture - I might sue!
If people are going to get upset over this, it's probably all over.

ya know, I was wondering what everyone was arguing over - I couldn't even SEE any "Bayani-like" boots in the picture..
Eventually, I had to pull the picture into photoshop, hunt around, zoom in a few times, and squint, ..even then, I had to crank the brightness up to even see any boots! Sheesh!

It was frustrating enough to submit an unfinished work, let alone one that was meant to be taken lightheartedly (which it seemed to be taken as such) until now, get blown out of proportion and cause heartburn between myself and someone I chat with and played with almost every TF Friday for the last few months. *sigh*

Friends jest with and take jabs at one another all the time. Assuming that these boots were meant to be his I would take it as gentle poke at how closely he guards his character, not as an insult. It would seem like the good natured fun friends have at one anothers expense all the time... I would think that if insult was intended that it would have been a lot more obvious and noticeable...
*shrug*. Thank god most people have a sense of humor or Pyro would have been lynched by now.
Man, I thought we were going to get through this month without a flame war. So close!
Ya, the irony is that this was a non-issue and would have stayed that way since these "time-based" threads typically disappear after each month's event and fall into complete obscurity. *shrugs*

From what I'm reading of the ongoings, I feel that the fault here is in the intentions of the piece, not the actuality of what's in it.
It's pretty obvious that Bayani was asked about his character and he refused. Then a very similar element of his character was used anyways, then written off that it could be anyone. Furthermore, it was pushed into the edges of the picture and then darkened, like it was purposely being hidden from view.
Don't BS us. It's obvious what happened here.
Now, if it was just a pair of boots with a flame pattern, it could legitimately have been anyone. There's quite a few people with boots like that. But it's everything, including the events that went on behind the scenes that make the problem clear. Intent is rearing it's ugly head.
Now personally, I don't care who's "fault" this is, as I see it as a purely social problem. Bayani can't actually control anyone who tries to draw his character, but he has his rights to feel the way he does about it. JK has every right to draw what he wants, but he is rightly subject to the backlash that his art might cause. It's up to the involved parties to settle the dispute. I just can't stand seeing people write off something this blatant as co-incidence. C'mon, we're not f***ing stupid. At least come clean with it and stand up for your actions.

However, here is a listing of events that did take place.
1) I told Bayani that I was thinking of doing a reference piece to the "artwh*res" (keep in mind that is not me saying a bad thing, that is the term they call themselves).
2) When I said this, Bayani said "don't use my character." It wasn't a technical, "hey man, can I use your toon." kind of question, but that is splitting hairs I would argue.
3) I drew some boots with a loosely sketched in flame pattern. No color on boots, and extremely darkened out. (these boots are common in the game)
4) Only one comment about the boots were made by CR (this is not me picking on CR, this is just a simple fact from what I can tell on the boards prior to this blowing out of proportion atm).
5) I gave no validation on the boards to the above comment, as I didn't know if I was being trolled (*according to EULA, inflammatory comments are considered trolling, and the act of claiming someone is trolling is also a considered trolling. *PLEASE NOTE: this is rough definition, not me trolling yeesh).
6) Had CR (as well as Vex and Bubba) on vent for a Friday night TF and this subject came up. I didn't bring it up, I just went along with it and I joked...I REPEAT joked by saying something to the effect of "Yes, CR this is Bayani getting blown up and all that remains are his boots." (Coincidence or not, after I say this...the next day this happens.)
7) Later on that night, when most were logged I thought and I also may have mentioned...can't remember now since I was very tired. "Man, probably shouldn't have joked about that since it could be redirected verbally and then misconstrued."
8) As for who, if there really was ever a specific character...there is no way I am going to comment on that now since I don't want to stir anymore potential backlash from someone else here.
This was a for fun piece, regardless of behind the scenes gossip, this whole thing got blown out of proportion somehow by only one comment on the boards (on a piece that wasn't even done yet, but had to be submitted as is). But honestly, coming clean or not, something definitely had to be said after the fact since prior to today everything seemed copesetic. It's frustrating and unfortunate and it concerns me that even as thorough and fair response I have tried to give here can be considered just fueling the flames, which is the exact opposite of what I am trying to do by explaining this to the best of my recollection. Not to mention the damage has been done, so coming clean or not is probably just a moot point anyways. Again, sorry for any misunderstanding. I'm moving on to my next (possible) submission now

The artist did not say it was <copyright name>'s boots - someone else did. And I'll bet that 90% of us never even saw then until it was pointed out, since the pic on DA was smallish and the corners dark.
Some of you really know how to take the fun out of this stuff.

Exactly Bayani, hence why I did ask you as I knew you were sensitive to your character being used for fanart and it is why I respected that and your character was NOT used. A pair of boots which were near impossible to see did not constitute your character. Could it be misconstrued as your character...maybe (and I would maybe joke as much as it is with you on Vent or in-game), however that argument is flimsy as that would be the equivalent of every off-screen part of a red cape would imply Superm@n EVERYTIME which clearly that wouldn't be the case as Statesman wears a red cape as well as countless other super heroes in CoX. I'm sorry if this reference to boots with a sketchy flame pattern instantly summarized your character. No reference to body, powers, your trademark star/sun symbol, face, glasses...hmmm, ya pretty much not you if it came down to real true likeness. So what is the problem again?
