Herostats tracks criticals, so you can attempt to disprove your theory.
I've often wondered when it says "the higher the level, the more criticals"
Does that mean litteraly what it says, or do you get extra criticals when the relative level is higher, Reds, Purples Etc?
The critical hit chance is higher based on the RANK of the enemy, AFAIK level does not matter.
Critical hits simply happen when you dont need them. They're inversely proportionate to their usefullness

It is based apon rank, i.e. Minion-AV.
For PvP it is worked out the same as vs a minion which some scrappers complain about as brute fury in PvP is built up as if they are fighting an AV (higher rank more fury built up).
P.S. Not theory 
in PvE it is said the higher the rank of the foe the better odds of a critical hits? from my understanding that means if they are a higher level than you, you are more likely to get a critical hit. or it could mean you are more likely to get a critical hit on a boss rather than a minion?
in PvP however how does this work? as in pvp we are the same level inside pvp zones and in arena theres never much of a level gap or atleast there shouldnt be. what i have noticed is those AT's that lack damage resistance are quite prone to be hit with a criticals. so is it the difference between the damage you do and there resistance to that damage type that causes the critical...that may explain why build up tends to increase the ratio.
build up also increases acc by using tohitt buffs...i have noticed that wen using follow up and and focussed accuracy at the same time i seem to get a large amount of criticals. some have suggested that using defense debuffs while increase the odds of it aswell. so is it a connection between your chance to hit your foe and his defense?
what i do notice is that while fighting SR scrappers they seem to get hit with critcals alot more after being attacked by a foe using build up.
i find it hard to believe that criticals occur randomly without any sort of catalyst.
