I want to say instance wide. I can't think of a time I've had it not be since SSK was introduced. However, that's purely anecdotal.
Edit: Testing's saying otherwise - working my way in from the "long way" on IP, I'm down to a mile and seeing no XP on a teamed character. Nothing 'til I'm within 100 yards. (Could've sworn I'd been farther away at times, though.)
In the city wide zones, it was somehing like 100-200 yard range from the defeat. There also was/is a point at which someone who is defeated ceases to gain xp (2 minutes?) until they Rez.
Not since the first big xp overhual (1/2 debt in missions, etc.) if ever has there been a distance leash on xp.
Note, if if the range prevents Xp, you still get kill credit for defeat badges and missions for critters defeated by your team in the same zone.

One of my favorite urban legends involved the christmas presents- the first year, one type gave you XP.
Someone claimed to have opened one of those presents, gotten bumped up to level 51, and had their character become unplayable until support fixed it.

Quick question, when you "Gain XP" what is the maximum range you can be untill you dont get the xp, or is the xp Instance wide? just wanna know if there is a range that the xp can go threw before you dont get any at all.
