I personally just don't think a 9500 is going to run Ultra Mode at all.
I noticed you didnt mention when your gaming system was made. Maybe 3 or 4 years ago?
Anyway a 9800 ish is pretty much the low end for Ultra Mode, and GTX 285 (or better) for maxed out Ultra Mode.
Anything inbetween those (and the ATI equivelant) will work Ultra Mode according to Posi, your FPS will probably be determined by how high up the list your card is. And of course assuming your CPU and RAM are already golden.
If I were you I'd seriously consider upgrading that 9500, cause even if it could run Ultra Mode, you're FPS won't be a pretty sight.
Brand new last year? Does that mean you have Vista 64 bit?
You dont need 8 gigs of RAM without a 64 bit OS.
Right now... My husband has the Intel I7 with 6 Gigs of Tri channel RAM... (something like that) I think it is Tri Channel, it was in a special glass case with like 4 nerds drooling at it, when I went in to pick it up. Lol. He has Win 7 64 bit home edition, and doesnt miss the other 2 Gigs of RAM you have.
He is playing AoC atm, with all settings set to Max. He does have a ATI 5870.
TBH, I think someone got over on you with your "made for high end gaming" computer.

I upgrade my computer every 6 months. Not really because I even care, but my husband likes to have everything super up to date (within reason)... And I refuse to have a crappier computer than he has. REFUSE.

I was doing some checking, with that gfx card you dont even need 8 gigs of Ram. Your processor doesnt need 8.

It was the biggest, baddest computer I could find. The rest I looked at in the store were lower end compared to it.

You make it sound awful, but it's quite the opposite. This machine hasn't lagged or stuttered once. It runs smoothly. From what I've read though, the m9500y's PSU can't handle a 9800GT, as the quad-core needs a lot of energy. I might as well buy an entirely new computer and I can't afford that right now.
A new PSU is hardly a new system.
Why wouldn't your case? You aren't really making any sense. I have never seen a case that "wouldn't" accept a replacement power supply.

Don't even worry about a 9800... That card is likely going to run UM on the lowest settings. What you want is something more like the ATI 5700 series/5800 series or an Nvidia 260 or better.

If it has been less than 1 year, and you have a Warrenty I would seriously call them up and ask them to explain to you why it is that you have a less than stellar GFX card. The people who sold you that GFX card... knew it was not a high end gaming card, you should see if they will upgrade you for free. Because basically they lied to you.

I still think he should get ahold of those people, phone/letter, and see if they can do something about it. I feel he was lied to. The people that sold him that computer knew it was NOT a "high end gaming computer".

Really it seems like most of his system is fine. I'd measure the PSU and get a new one. It's almost certainly a standard size. If space for cables is tight, get a modular PSU because it allows you to not connect cables you don't need. And remember: Newegg is your friend.

I dont think it works the way you think it does.
We will see when it is time to test everything, but its still only 2.4 Ghz
Right now I have a i5 and it runs normally at 2.8 Ghz...
Just curious but what year was your gaming computer created?
Example: Can you play Crysis on High Settings on your current gaming rig?
