But according to Microsoft, the bans were forewarned to everybody, so they could have and probably should have avoided the situation they may find themselves in now — Banned. Even modified Xbox 360’s with the so called stealth detection have been found stripped of their Xbox Live badges.

Even if you don’t download and play pirated games, but have modified your console to ‘look cool’ or even play backup games, you are potentially on the ban list. No matter what you do, if you modify the Xbox in any way shape or form, you have violated their Terms of Service which you agreed to when signing up to Xbox live.

In another side story, it is reported that craigslist has become flooded with second hand Xbox 360’s lately, I wonder why that is? So for your sake, I’d think twice before buying any second hand Xbox right now.

Ouch indeed, but its their fault. People thinking they can get away with violated the Terms of Service agreement cease to amaze me. I wouldn't be surprised if most of them are throwing a hissy fit, trying to prove they did bugger all wrong.

Agreed. I have no love for piracy, but Microsoft patches all the time to prevent Xbox owners from running homebrew games / alternate operating systems. If I buy a piece of hardware and I want to run Linux on it, I should darn well be able to.

Two things:

It's for Live and part of the agreement is clear; they can do whatever they want.

This doesn't stop you playing your hardware; it stops you taking it online.


And unless you're a PC owner running something besides Windows; you're in exactly the same boat as the 360 users.

And I chose to do whatever I want: stick to PCs, where I can run for a week on Ubuntu if I feel like and then go back to Windows and my Windows games will still run online. Or I can even run those same games on Linux; Steam works very well under Wine.

PCs got this far by being an open platform anybody can develop for. Huge things have started out of a single homebrew title distributed via shareware (Commander Keen -> iD software) or even freeware (Narbacular Drop -> Portal.)

What I run when I'm not playing an online game should have no effect on my online experience. As long as the game has a valid product key, it can be safely assumed it was not pirated; there's no reason to then block the user from playing their legally obtained game because they decided to try some homebrew stuff.

OK, by subscribing to Xbox live, you accept the terms and conditions of that agreement. One of those says that if MS detect your Xbox has been modified in any way, MS can, at it's sole discretion, ban it from Xbox Live. You can still play your games offline as, yes, it's your console and you can do WTF you want with it. If you go online with it, expect the BAN HAMMER to come down eventually.

I see no conflict between what you're saying and what I'm saying. All I say is: I won't buy a product when the license agreement for some of its features prevents me from using the product to its fullest. I'm not demanding any changes; they can keep the license agreement as limiting as they want -- and I'll keep on staying away from them.

(Incidentally, that's also a reason why I tell everybody to build their own computer or let me do it for them; buying a pre-built computer usually comes with a warranty sticker in the case that if broken for any reason, invalidates the warranty. I won't support a business that forces me to lose benefits, even benefits I would never use, because I opened the case to install a video card, or even just to look at the inside components out of curiosity.)

I hardly play on my Xbox these days, in fact I've just this minute cancelled my gold access. Of course thats mostly under orders from the other half..
