thats the thing though how does the system know the content of a file still in transit? are thye just blockingthe file name?

That seemes dubious since their could be other people with similar file names

It certainly wasn't blocking the file name (unless you know of a song/video called "Low Cost Villainy 001.") I'm not sure what they were doing. It *has* to be either recent, or complete BS - though the specific error message makes me doubt the second. I say it has to be recent, since I've uploaded other quick vids there with songs and whatnot without problem. (And I don't think "Everyone's a loser" is so popular it'd be instantly recognized...)

Well, consider if the music file you're using in the video has electronic tags for copyright info? I don't know - but it seems likely to me that in the interests of actually protecting those copyrights, they actually get down on folks for uploading things they don't hold the right to use...

It's a case of on one hand, yeah, it's your music if you bought it. On the other, you do *not* have the right to broadcast it. So.... I dunno. It doesn't surprise me that youtube or anyone else would be taking what appears to be "appropriate" measures.

All folks have to do is *ask* for permission - I bet no one has ever even bothered... o.o Like, in the history of posting videos.

I've had several items deleted by Photobucket mods on my Photobucket account, actually. Really silly things too... its really not all the different than DA, just more pictures for the jerks to dig through first.

What is it that they delete on Photobucket?

Not that I would care if everything I put up there got deleted.... I just use it for preliminaries and things if I'm not dealing with a commissioner via email.

As with any company which has publically viewable stuff, any pornographic images - and the interpretation is always "whatever the person viewing it thinks" is porn; obviously stolen items (such as "look at all these great Boris Vallejo images!" - yoink! gone!); any image which promotes hate or violence, any image which depicts criminal activity ("lookit my bros and me getting wasted and spraypainting on this store wall!" - yoink!), basically something that doesn't belong to you that you put up.

The hosting companies MUST adopt a "better safe than sorry" attitude and remove the offending material regardless - but if it's NOT offensive, or it DOES belong to you and you can prove it, they will have to put it back up. That usually requires a legal notice of copyright holding, or permission, or proof that you own the item... etc.

Just because you rent an office space, doesn't mean you can run a porn shop out of it. Just because you rent a storage room, doesn't mean you can grow weed in it. Same thing: if it's "technically illegal" online, or if it's likely to offend someone who IS going to be browsing your area, it should be taken down.

Now, that said, Gamma's situation is annoying as hell because of course the people of DA are idiots. Ee-dee-ots. Their copyright and offense admin are retarded. I'd consider trying to apply for a job with them just to lighten their load and give the benefit of the doubt to the RIGHT people, but then again the admin there *are the only people who've regularly insulted me* on DA. So go figure, the help they need most from someone who HAS studied up on copyright and laws like those, won't be allowed in because of their incredible cliquish attitudes...

Fair use states one is allowed to well use their material fairly

Fair use the the back bone of user created music videos.

Once they start denyingthat (especially on youtube which was built of user created music vids) your shooting yourself in the foot

"Fair use" is for schools and libraries, and for small (less than 10 second) snippets of songs for *review purposes only*. You need to read up on that if you are going to try using it as a defense for posting things that don't belong to you.

I realize that "user created videos" use music that isn't theirs. But they by and large have not asked for permission to do so. Fair use as you see it is "if I grab it and use it it's mine", which is not true and not legal. Having gone through a lawsuit about this subject, trust me: your impression doesn't hold legal water, I'm afraid. It's not a "right" to copy someone else's work. You do not have the "right" to use music that you didn't create, unless you get that right in writing from its creator. You may use a tiny portion of a book, scene from a movie, clip of music or soundbyte as I said: in the form of a review or for educational purposes.

Just because you want the internet to be "free for everyone to use" ... it isn't. Sorry. No one is "denying" anyone's rights by taking copyrighted material away from people who aren't supposed to be posting it.

Uuuuum, yep!

Don't you remember how many threatened lawsuits and removed material there was in YouTube's starting years? Just that there was nobody worth suing behind it. I remember when Google bought it, people thought the lawyers would be in hog heaven since some money was finally there to sue for. Didn't quite go down that way.

Indeed. That's also why the have put advertisements on every video they've identified as belonging to a specific studio or owner: because the owner can then track how many ads are seen on their video and get their "due" for it. If they don't have the right ownership and copyright on the video, *the proper owner of the video - be it the music, the video, cartoon, script, or whatever* will not get their copyRIGHTs.

I'm not saying that I agree that this is all the best way to do this, but it IS the way we've got. Don't like it? Go to law school and start championing for change.

Oh, some were probably because of being suggestive. Others likely because of copyright or something. Honestly out of the dozen or so pictures I've had removed form Photobucket over the last few years, I've never been able to figure out why or any semblance of a pattern in it. They'd go through a album of similar pictures and delete two or three and never touch the others.

I found it funny I had a piece of work up for almost...3 years and it got removed several months ago, believe it got fav'd 10k times before it got took down.
