Even if, and that's a big "if", they knew these enhancements were coming when they announced the pre-purchase early access bonus, there is no deception involved.
As to whom they chose to partner with, I'm sure there are just as many, if not more people, that dislike Best Buy (like me) as there are those who dislike GameStop. And Amazon is not a "brick and mortar" retailer, which is what they are clearly targeting.

I highly doubt that any actual work is being done on the project, because it would be silly to wait so long to trademark the name.
Additionally, there's no guarantee that it will ever get off the ground.
