According the the wiki, yes: "This enhancement functions as a set bonus and is always on, even if in a toggle that is turned off or even if the power is greyed out because of exemplaring. However, the bonus of this Special IO is turned off if one exemplars more than three levels below the level of the Special IO itself, unless it's from a PvP Set, in which case, level doesn't matter and it will always work." It's better to save the Mystery, than surrender to the secret...
I will add, if you're buying it with HMs there's no reason not to get a 10 just in case you ever want to move it to a low level character.
Not sure if it's been fixed, but it might be worth mentioning that the last time I checked characters below level 12 cannot slot that IO.
