It's a level 30-35 "signature" TF so everything should spawn at 35+. If the boss is spawning at 34 that's a bug. If she's supposed to ramp up (however much) and isn't, that's a bug.
Hopefully when they fix the difficulty settings for all TF's this will get fixed at the same time.
I did the KHTF the other day for the first time in at least a year. She remained level 34. I could have sworn Mary gradually spawned higher. I thought I was remembering incorrectly.

but still, you're not gonna take a entire teams of lv45's and expect to beat the STF, same should be said for Katie Hannon with the minimum level requirement. The other reason for running Katie's is quick cash.

Still, I'm sure she used to scale up (and the wiki confirms this) so that part is still a bug.
This bug has been discussed on the forums before and /bugged in-game many times.
