Aren't all the Lovecraft/Cthulhu things fair use? I was pretty sure it was one of the few IPs where the creator(s) were happy to have the mythos continued by other artists in future endevours. I'm almost certain that anyone could write an original Cthulhu mythology based tale as a prose work (if they were so inclined) without any legal entanglements.
May well be that it's different when it comes to multimedia ventures. Besides, I doubt the devs would bring over the exact entities. Unless this is the oft-rumoured coming storm (which I don't see, simply as it could divide the fanbase and doesn't have much of a basis in-game at present) smooshing the Lovecraftian into COH/COV would pretty much dwarf every other threat.
