Yes. This is a known issue. I can't remember what it actually is, but no doubt FFM will pipe up soon to explain all.
Disabling SLI mode is the solution, I believe.

Seems people have had problems with the 8800's and SLI on this game. I have SLI disabled on my pair of 7800's though it doesn't make any difference at all that I can see.

I have 2 ATI 3870HD cards operating in CrossFire, and don't have any issues with it

Not noticed any difference with my 2 x Nvidea 7900's in SLI although looking to perhaps get a nVidia GeForce 9800GTX+ 512MB PCI-E. That would be better right?

SLI mode with 2 nVidia cards, doesn't work well with City of X ? (Villains mostly as that's what i've been playing lately).
2x 880GT's in SLI Mode. noticed it over the the last 2 weeks mostly as that's when i started playing Villains more than normal, to push for a 50 on the red side.
I'll take it out of SLI Mode tonight to test, but wondered if anyone knew if it was common knowledge that you get slow down in game in SLI mode villain side. I do understand Villains uses more umph (non technical term, obviously) when it comes to graphics, as blue side has been fine prior to switching to the red side.
