Newbie DM/DA build
3 acc in your attacks is overkill, i'd swap one acc for endurance reduction in each attack. Dark Armor is endurance heavy, having endurance reducers in your attacks will help in this department.
The Flight Pool might not be the best choice for Dark Armor as it is lacking knockback protection. Leaping pool has acrobatics wich will helps a lot as you will get knock'd back alot and thats 2 second you can't do anything and faceplanting usually happens
I'm with yeek on this leaping is a lot better for /DA for 3 reasons:
1. Immob protection in CJ is cheaper than the DA immob protection
2. Accrobatics gives knockback proection which DA doesnt have
3. Fly is end heavy which combined with probably the most end heavy secondary going means you will have serious problems in PvP zones when running most of your armours.
To fit these in I would drop deathshroud as I believe it to be the most end heavy toggle DA has and probably doesnt add sufficient damage to justify its end cost.
why does no-one take shadow punch...shadow punch/smite/shadow maul chains so good^^...or shadow punch/smite/air sup/midnight grasp/shadow maul..most squishies will be down:P
To add to your point sometimes you nbeed CoD and CJ for the imob protection as neither alone give as much status protection as most sets get. Together I think they give a little bit more.

Cynic as you have a lvl 40 /DA brute do you get much damage out of the damage aura or not cause at the levels I played with a scrapper and a brute it didnt seem justified for the end cost. I was pre stamina and SO's so it might change then but I honestly couldnt see the reason for including it in a build that is very end hungry anyway.
Also, you might have overslotted Soul Transfer a bit, unless you plan on dying a lot.
Dark regen 2 acc 3 heal 1 rech is not really good slotting imo. Its a endurance heavy power. and it already heals 1/4 per mob hit base. 2 acc 3 end 1 rech is a better slotting, the recharge is pretty fast on itself.

Death Shroud and Cof, or Death Shroud and OG should keep fury at a decent level and damage taken low enough. Taking both costs alot of end and might lower your fury too much, I'd only take all three for serious PvPing. OG can live with less slots so it's your pick.
(CoF: 2 acc, 2 fear, 2 end, OG: 0-2 disorient, 2 acc)
Soul Transfer need 3 slots max (I have 3rech now, great for annoying granites in PvP but recharges fast enough outside of PvP).
Dark Regen will do with 2 end, 2 rech, 2 acc. Can add some heals too for more serious PvPing (less mobs = less hp healed).
Taking Obsidian at lvl 10 will make life easy early on, Air Sup can wait.
And SJ is the best TP for /Dark and / Fire, flying will do but you're going to be very slow and end heavy.

3 accuracy I would agree as being overkill on other powersets but I've played a few scrappers and DM always seems to be that bit more innaccurate (entire attack chains gone with no hits at all), maybe it's so the acurracy boost with soul drain doesn't give DM's too much of an advantage
My decision on the flight pool was really more of playability than practicality since fly was the only travel power that doesnt make my game freeze up every few seconds. However I see your point so leaping it is
Death shroud I have dropped as I experienced how end heavy it is. The damage is nice, at lv8 with full fury I'm doing around 10 Damage/second to all surrounding mobs but if it's gonna keep on disabling my shields or making me unable to use my normal attacks then it's not worth it. On a side note I forgot to put Murky Cloud in that last build so it replaces Death Shroud.
As for shadow punch, it has the same damage as Air Superiority and was hoping to use that instead of hover which I always feel is a wasted power. However with the move to leaping and the realization that AS has a recharge time closer to smite than shadow punch I've gone for the punch.
Thanks for the slotting tips I was really just floundering about with them since I've never used the powers yet.
So for your scrutiny here's my revised build. The last 3 powers are open to debate, I only chose medicine as a means to obtain the healing badges and also since being able to aid self between fights and rez fallen party members, in the absence of a dark/empath/rad/etc defender or controller, sounded pretty handy

Played around on test with it (as I didn't have it to start with) and decided it's not worth it, but mostly because I have the AoE damage covered anyway.
Oh and the Dark Regen question, for PvE the best slotting I've managed is 1 acc, 2 end, 2 rech, 1 heal, cause you get over a third back from one target so is good for AVs, is freequent enough and doesn't cripple you when you do it.
I also dont have CoF, that's a massive end cost and discourages them for hitting you and building fury. On the Da side I only have 5 powers. 3 shields, CoD, Dark Regen, I cope better without all the others (having a respec before copying to test really helped me prove what I thought I already knew) but then that's for my play style and with the AoE madness of fire

I'm only vaguely familiar with the DM set from using a DM scrapper and have just rolled a Dark/Dark/Mako Brute to act as my main villain. He'll be mostly PvE but as a badgehunter I'll b heading to PvP to get the rep badges as well
So here's a build I drafted up. Smite, Air sup and Shadow maul form my main attack chain with touch of fear on the side. Not sure where I'll fit in Spirit shark, Midnight grasp or Oppresive gloom. After lv30 I was kind of grasping for powers
Also the Superspeed at lv49 is for RV since on test I saw that flying there is suicide
