It functions like a Luck of the Gambler Recharge or Karma -KB. So yes, it's always on, unless you exemplar more than 3 levels below the IO.

However, this question often comes up because the icon for it shows up sporadically under the health window. Ignore it. It doesn't reflect the reality that it's always on.
