Yup. When the in-game store is down, any empty slots past the initial 12 won't be available. So, in your case, you would need to delete 4 characters, so that you have 11 filled slots, and 1 empty slot.
Unless you don't care about the characters, your best bet is to just wait for the in-game store to return.
