5th Column killing Council?

I did a "Defeat 10 Council" in Steel this morning, and I didn't get the "Council lying there not fighting back" thing. I *did* attack some of the ones lying down, but they'd get up and fight back (usually being attacked by the 5th around them at the same time).
I was glad to see that I got credit for Council kills even if all I did was take off the last sliver of their health after they'd been attacked by the 5th, because I had a lot of trouble finding pure Council spawns. 
Hell, maybe it's because I killed all the 5th first, then went for the reclined Council. I will try it your way, and see if he fightss back! Thank you for your reply.

I was doing a 'kill 10 Council' in Steel and went looking for them. What I found were the 5th killing Council in almost every group I found. In many cases, the Council guy was laying on the ground, unconscious, surrounded by the 5th. I chose a group like the previous scenario and got rid of all the 5th guys. The Council remained on the ground as I pommeled him! He never fought back.
I finished him off, and eventually completed the mission. (I did find single Council scattered about.) I was just wondering if this is a bug, or wai. It seems to me that the Council guys who are just lying there should fight back after they are alone and attacked. Anyone else encountered this?
