Looking at the post now it sounds a lot like who would win out of batman and superman lol.
Brutes do have EM, SM and SS which in normal terms all do insanely good ST DPS, but in new PvP terms might do anything at all.
But as you say same sets I'd probably pick the scrapper if it was good burst set and brute if it was one that was better over time (more HPs + Fury)
Could I go with "the one with the better player?" or would that be too radical?

Yeah but dont forget we are in i14 pvp now 
player skills went out of the window long ago.

The standard chance for a Scrapper to land a critical on a player is 5%. So from this fact and personal experience, I'm going to say Brutes.
The higher the level of you both, the better the chance the brute has.

I always wanted to know, in a straight out fight with the same sets, same powers which one is likely to win?
Brutes start off lower damage but they get increased damage with fury. Scrappers get crits and have inately more damage.
