Hehe, that happened to me with a McDonald's prize, one of those ones you peel off the cup. The question wasn't as simple as Zombie Man's, it had some addition, subtraction and multiplication, but still not overly difficult. correct, but I tend to avoid it anyway....mostly I have a bunch of inspired by myth or inspired by anime characters without actually completely copying said anime characters (usually I mishmash ideas from multiple sources when I'm creating any character anyway....myth being a very heavy draw on origin concept for me)

If you expect to profit off of an original character or otherwise keep sole ownership of it, then it's best if you don't introduce it into City of Heroes. That's been the rule of thumb since day one.
That said, the clause in question primarily is there so that NCSoft doesn't have to pay you a license if you've published the character in another medium and they decide to use it in a story or promotional material or something. Remember how Ascendent showed up in an issue of the Top Cow comic and Amberleigh(?) and the others in the Blue King comics? I'm sure that those players were thrilled to get a guest shot and had no ideas about profiting from their appearances in the CoH comics, but that EULA clause insured that NCSoft didn't have to worry about it.
Basically, if you want to keep all possible rights to your character then keep it out of the game.

That being said, it's important that you, as the customer, know our response, especially in regards to something as sensitive as individual privacy. Westely, and anyone else who is expressing concern, is well within their rights to do so. Take it from someone who puts his real name, identity and livelihood out there for the whole world to see; having the safety of your privacy is very important. I understand this as a consumer, as a gamer and as a father and husband. -

Well, not really considering how broad those EULA terms are. If they actually took it literally and tried to enforce it, it looks to me like they are claiming the right to do everything from install a keylogger to steal your bank password, to remotely turn on your webcam and watch you walk around naked*. I don't really think they will, but the EULA really is written ridiculously broadly; so much so that NCSoft would be protested and sued out of existence if they actually tried to exploit it as written.
*Not that much of a joke; there was a school that did that with its take-home school issued laptop computers to "monitor the behavior" of the kids. It didn't turn out at all well when people found out.
Which this does, in no way, violate. Just like how you can say whatever you feel like and then get fired from a job over it, any company you do business with can terminate said contract if you say something they disagree with. There is no "Freedom of Speech" in a video game.
That is how he's misapplying it here. But you did give him a pretty good out to try to rationalize his misuse of the term by adding the paranoid webcam business he's sure to latch onto. -

Here's the thing I'm wondering: how long has Westley been crafting this latest I'm RageQuitting thread.
Think about it: he hasn't played in months. When I posted on Unleashed before I learned better he barely talked about the game except to complain. News of the new EULA has been out since just before September 1st yet it took 10+ days for this thread to start.
How long was he planning just the right things to say? Obviously, not long enough since he misused the words "civil liberties" so mightily. How long was he planning just the right time to post it? The Sunday morning, guaranteeing him a full day of it being live, just days before he can continue having an account? Perfect!
The sad thing is I think Westley spent more time fuming and ranting and constructing this original post than any NC Soft lawyer did preparing the new EULA. And for what? For him to return and rage quit over something equally stupid two months down the line? -

Violating an NDA is a breach of contract. Same for showing disassembled game files; it's also against the DMCA. Stalking and harassing are illegal in and of themselves.
We don't need language in the EULA that would allow someone at NC to kick you because they don't like your political opinions.
You and your opinions (or even My Opinions and I) are not interesting enough to warrant any company hiring anyone on full time with benefits just to monitor what you (or I) say and like. -

If they really want those old players back, then they ought to be implementing a plan to explain the new system in glowing, positive terms and to offer some kind of incentive to come back and try it out.
However you slice it, a lost sale is the fault of the salesman, not the customer who's doing his best to recruit other customers.
But onto your other point: do you really thing there won't be mass emails once VIP Headstart ends promoting this to anyone who has ever had a NC Soft Play Account? It will be promoted in glowing terms there with links to explanation of benefits most likely. If a player doesn't take the time to read those, I really can't fault the devs or the marketing team for that one.
And what other incentive is needed? "Come play this old game you used to play... FOR FREE" is a pretty damn good incentive. -
Let me play devil's advocate here: wouldn't it be better for all teams if more members of said teams had Return to Battle? Who cares how they earned it as long as they had it.
