Error in respec?

Have you hit level 49 yet, when you gain your final power?
Main Hero: Chad Gulzow-Man (Victory) 50, 1396 Badges
Main Villain: Evil Gulzow-Man (Victory) 50, 1193 Badges

The first power in your secondary powerset is automatic. Mid's counts that in the total you can pick, but it is actually automatically given to you.
I can choose 24 powers in mids, but when i try to respec, i can only take 23 powers? So can someone tell me whats the deal?
