I was on an 8 man team running a level 34 Rugged Crey mission Tuesday night. We ran across quite a few level 40 Paragon Protectors.
It isn't that we minded because the party was 33-36 and it was a welcome challenge and very fun but this from Philotic on another thread reminded me about it:

So I thought I would report it as a bug. I'm sure nothing will come of putting it in this forum but what the heck.
